CRAZY BOSS - Need your suggestions

I finished my beautician school last year, and did put my CV on a Belgian job-search website. In January, a lady – owner of a SPA - called me, saying that she’d loved my CV and would like to meet me to a job interview. We did the interview in a restaurant (the SPA /beauty salon was in construction) and we’ve booked a practical test. Everything was ok, and the lady decided to hire me in the end of February (when the SPA would finally open).

Well, the SPA didn’t open on February, or March. She changed the opening day lots of times (the SPA is always in construction) and the lady doesn’t stop calling me (to my private cell number) for the most idiot reasons. She doesn’t leave voice messages (or send a text message, and simply calls 7 or 8 times per day (even on Sundays). An example: we had one week of training courses (last week - in order to work with an specific cosmetic line) and she decided that we have to meet on April 6 to a work reunion . I said OK –we’ll meet on Thursday (April 6). Yesterday she called 7 times and 11 times today. I know that it’s not important (she only wants to talk with someone), and I didn’t answer the calls. I’m completely tired of this situation and would love a calm and peaceful weekend with my family, without her phone calls. She didn’t leave a voice message, as usual

I had to do trainings without any contract or pay. More than this – She wants to be paid for the training days. She said that the training courses were very expensive, and, as she doesn't know if we'll work with her for 1 year, she will ask us to pay the training courses (that we were obligated to do, in order to work with the specific cosmetic line). So, she decided that she’ll make a parcel debit in our first pay (salary).

She also said that she’ll declare us as half time workers, paying the salary (as half time worker) in a bank account, and the rest “in black” (no declared cash). It’s completely illegal, ‘cause I would be a full time worker.

It’s an unreal situation – She’s not my boss (I didn’t sign a job contract – the SPA will open in April’s last week) and she doesn’t spot disturbing me with crazy phone calls. I’m seriously thinking about don’t signing the job contract. What do you think? Can you give me some advice?

    XOXO,

    Nelci.

PS – Excuse-me for my horrible English :0)

Reply: Are you joking? In my opinion, I think the whole job thing is a fraud. Can you find someplace else to work? Even if it is doing something else for awhile. If you didn't sign a contract with her, I wouldn't pay her anything. Plus, she is just harassing you with all those cell phone calls.

Reply: Nelci, Even if this is legit (they are stringing you along), its only going to get worse as time goes on. Give your notice now and look for a new job. You should not be expected to train for free, let alone pay for the training yourself.

Reply: RUN AWAY FROM THE CRAZY LADY! ! ! First of all, it sounds as it you are not even hired yet??? If there is no contract signed, she cannot make you pay for any trainings you took. She can take them out of your paycheck, but you would be foolish to let it go this far. The next time she calls, tell her you have already accepted another position and to STOP calling you - then look for another job. You are letting yourself get into a no-win position if you continue expect to work for this person - she's a nut case.

Reply: I will assume that Belgian law on what is necessary for an employment contract to exist does not differ from the law in my jurisdiction. Under no circumstances should you consider signing an employment contract with this person. She may be mentally ill, a fraud, a dishonest and incompetent businesswoman, or just very lonely and odd, with nothing to do. It does not matter: she will never be a good person to work for. CHANGE your cell phone number. Communicate with the cell phone company and tell them you are receiving harassing telephone calls. If you hear from her again, find a lawyer (avocat) and threaten to sue her if she does not leave you alone. And remove your CV from the website. Placing personal information like that in the public domain is asking for unwanted attention from psychopaths and frauds.
