be threatened wit termination even though i have a doctors note

I had fell and got a personal injury while I was not working. I tore a couple ligaments in my ankle. I was told by my doctor that I should be out of work for 3 weeks. I called and told my supervisor what was going on. She told me that if I didn't come back to work in the next couple days that there would be a good chance I would be terminated. I went back to work the next day but I was in agony all day and I don't think I can get through another day. Is there anything that I can do about this?

Ask about (DEMAND) information about FMLA. May depend on how Large the business is where you work if you can utilize this, though. You wouldn't get PAID for time missed (you would have to use Sick Time,vacation, Personal Days,etc...) BUT... you won't be FIRED either. I am NOT too sure if your situation warrants FMLA...but... YOU SHOULD DEFINITELY GET INFO ON THIS...NOW!!!

Do you have Short Term Disability? If so, use it!
Act Quick...because for you to be told that by your Supervisor means one of three things:
1. Your SUPERVISOR is Incompetent.
2. Your Company SUCKS.
3. No Offense Intended... I don't know your WHOLE STORY... if you "habitually" miss time from work for "mysterious" illnesses, etc... Maybe your Supervisor's comments are warranted. |

Here's the FMLA info - if you're in the United States AND if your company has more than 50 employees within a 75-mile radius AND you've worked there at least a year AND you've worked at least 1250 hours in the last year, then you qualify for job-protected FMLA leave. If even one of the above doesn't apply, then unfortunately you don't qualify for FMLA leave, and you can be legally be fired for being absent from work, even with a doctor's note. Unfortunate but true. If you're in Canada, let me know as your options will be slightly different. |
