    Written up

    I was written up today for not calling in sick, I did - my supervisor lied. I was written up two years ago, but not for the same thing. Neither write up had to do with the other. The notice says that if I am written up again I will lose my job - is this legal??

    I thought that you had to be written up for the same thing at least twice before you could be fired??

    Also don't they have to give you a copy?? What if they don't is that in violation of your rights - I think it is??

    Reply: Bad news again - employers don't need to "write up" employees at all before they fire them. They can fire their employees any time and for any reason, as long as that reason isn't based on things like race, gender, religion, or disability. This is called "at-will employment" and is a legal concept in the US. Also, when employers do choose to write up their employees, they are not legally required to give the employees a copy of the write up. I know that it seems like all I'm telling you is negative, however, that's how employment law works in the US - it is very much NOT employee friendly! And please don't shoot me down for telling you the truth, I don't make the laws (and I certainly don't agree with many of them!), I'm just the messenger. If you'd like to change the laws, I recommend speaking to your congressperson. Changes are being made right now at the federal level, and with your help, maybe more can be done to protect the average American worker.
