    Allowances for Breaks

    My boss's theory is that you work from the minute you walk in the door until the second you leave (with 30 minutes for lunch). I agree that we are paid to work; no problem with that at all. We are not allowed to make any personal phone calls...not even one. Life happens and sometimes it is difficult to get personal business taken care of. Is there anything that says we are allowed breaks during the day? They say no. They "allow" us to go to the bathroom, as they say. We are in Louisiana

    Reply: I can relate asserrin...my boss wants every minute of me . I havent gotten a raise this year and in 7 years I had only gotten a 3 dollar raise I do NOT get a break...my lunch is when we are done with patients ..so I start at 9am and can get anywhere from 2:30 to 3 !! no breaks !! I know there must be a law some where can someone help me please !!!!

    Reply: I suggest that you go to the "Not Respecting Legal Rights" section of this site and look at both links to federal and state legal resources to find out exactly what provisions exist governing breaks and lunch breaks.

    Reply: I live in TX, where employers must allow you two 15-minute breaks and a half-hour lunch in an eight-hour day for hourly workers. Federal law states that this is the case for large businesses nationwide. You need to check the laws for small businesses in LA, to see if they are in compliance. As for the phone, I would get a cellphone if I were you. Or, maybe you could talk a friend into borrowing theirs for a bit if you had to make a phone call. Employers are not required to allow phone access. But what is this nonsense about the bathroom? How disgusting. A human body needs to eliminate waste on its own schedule, not theirs. I hate to say it, but I think you work for a bunch of controlling jerks.
