Are their certain guidelines for a position to be salaried vs hourly pay?

Reply: No. Hourly pay and salary pay are methods of paying employees, just like direct deposit, paycheques and cash are methods of paying employees. All five of the methods I've listed are legal in both Canada and the US. However, I suspect you're asking about whether certain jobs should be paid overtime pay, and how to determine if your job is one of these. Let me know if this is what you're really asking, and also advise me of the following - whether you're in Canada or the US, what your job is, and whether you supervise or manage any other employees. Once I have this information, I'll be better able to provide you with a full and accurate response.
