payment of overtime

Hello, Could use some advice here. Was recently shorted 5 hrs of overtime pay due to a data input error by a payroll clerk. Upon contacting a payroll supervisor, I'm told that I will have to wait until my next payday to receive this money. Is there not something in the labour code that states that an employee must receive payment for all work done within a certain time limit? Look forward to any comments. Thanks!

By the way you spell "labour" it looks like you're in Canada. If you work in a federally-regulated industry (like interprovincial transportation, banking, telecommunications, etc.) google "Canada Labour Code" to get the federal employment law website, where you'll find your answer. If you work in any other type of industry, google your province name + the words "employment standards" to get your provincial employment standards website, which will give you an answer to your question. If you're unsure whether your company's industry is federally- or provincially regulated, tell me here what your company does and I'll try to figure it out for you. (And if you're in the US and just spelled "labor" incorrectly, then call your state DOL with your question.) |
