Was he suppose to ask these questions?

I applied for a position last year in June. I got called in for any interview in August. A week later I got called in again to fill out the paper work such as w-2 forms, criminal background check, etc. Well, during that the boss asked me questions that I knew were illegal but answered them anyway because he caught me off guard. These were the questions that he asked: Why does your SSN start with that number? What city and state are you from? WHAT HOSPITAL WERE YOU BORN AT? (I did not answer this question) Are you married? Do you have children? Was he suppose to ask these questions during the application process?

I really don't know the technically correct answer as to whether or not these questions were legal. But really, Nina...take it from an old Lady...tell 'em what you want 'em to know. Why does your SSN # start like that...offer to call the SSN tomorrow and find out...City and State...no worries...tell him...What hospital.....I told one boss that I really didn't remember the name of the hospital..but I would be happy to call my Mother and ask HER...Are you married? Who cares? Is the boss trying to be sure you're going to be free if and when he 'needs' you...or is he snoopy? Do you have children? I told one boss that I had 16...but was still trying to make a family! Enjoy life, let 'em make fools of themselves...but keep notes, Nina. Then when YOU are interviewing for YOUR company, you won't ask the same DUMB things!!! Ain't life a corker? |

No, these are (for the most part) absolutely NOT legal questions and you should not answer them! Where you were born, where you live now, whether you are married/have children should be irrelevant, but could be held against you. For example, an interviewer could determine from your answers that you live too far from the job and/or will be too busy with your child/husband to be an effective employee. Conversely, some places only want "family" employees -- which means married people. This is, of course, discrimination. The SSN question is just stupid. All those numbers will tell anyone is in what state the card was issued. |

As an FYI, the first 3 numbers of your social security number designate in what state it was orignally issued. That may have been why he was asking where you were born, although I can't see why an employer would care.
As an HR professional and a recruiter, I would make sure that the HR Manager knows that these questions were asked, as it opens up the employer to all kinds of issues. Sounds like someone needs some HR training!! |

Thanks for telling me that HRSTEPH. I did go to HR and I hope that they do something about. He's done a lot of things to me that he shouldn't have. Yet no one believes that he does that. Why, I don't know. |
