when you are off sick

when you are off on the sick,can your employer phone you up and ask the following?1.what is the reason for your absence? 2.how long do you think you will be absent for?. 3.what are your restrictions while absent?4. would you be able to attend work in any capacity?

Yes they can. I used to have a boss who called EVERYONE at home when they were out sick, under the pretense of "seeing how they are feeling" when I really think she was just making sure we were home. I will add that any questions about retrictions must be work related. |

I guess with HIPPA our bosses are allowed to ask why were out sick |

I suppose that there is also no reason why one could not let the answering machine pick up, with the rationale that your are sleeping/too sick/don't feel like talking. |

My boss used to call from her cell phone and hang up. Other employess would get similiar hang ups while they were out sick as well. I would think, if it could be proven, that this would fall more into the category of harrassment. |
