Using Zen and stragey to dealing with conflict was a workshop I attended recently at the University of the Sunshine Coast, Australia. Therse is more information about this course for conflcit management at http://www.AppliedZen.com, they have publications and run Australian and US workshops.

Can Employment assistant programs help with workplace stress. How can a employee address a retaliatory vindictive and false performance evaluation with out further escalating the bully type situation.

Sound advice although I do not agree with the part about HR wanting to help if they could ie based on my own and others experience of HR managers who try to trivialise bullying complaints. And this is in a country (Oz)where HR managers not only can but should step in (because bullying is now covered under OHS&W legislation). So, "steelhead" by all means use the free counselling service provided through your company's Employee Assistance program if you are comfortable with the counsellor provided (you need help/moral support. As to your other question, if you are saying that you are being victimised subsequent to lodging a complaint with your bully bosses's superior or HR I suggest you request a temporary transfer to another branch/department while matters are being investigated (assuming you still want to work there). I both empathise and sympathise with you.

What do you do if they refuse to transfer you?

Or what if you can't be transferred because there are no places to transfer to? In other words, there is only one office and your direct boss is the owner?

I had one mentor tell me, "IF they don't value you, leave". Easy if you don't need to work and have some other company to go to for a job. Contact EEO and ask how they can help you if you decide to fight for you right to contribute to the company's bottom line -but find out if the company's view of contributing to the bottom line is to let go of "X" number of personnel. It may not be about you or your performance at all - only the bottom line. If that's the case, do what you need to get your severance package and leave on good terms knowing you have value and can add value to another company - maybe, your own company. HR is hired by the company to work for the interest of the company (not necessarily for the employees). Make a plan and proceed - follow your gut.

My HR Manager has withheld money owing to me twice in past 2 years and refuses to give it to me. Each time I complain over her head she retaliates and will take it as far as going to Superior Court just to be vindictive and hateful. I have been off for 2 years with an injury. The first money withheld was vacation pay owed since 2001 and now I won the Work. Comp. Appeal and they sent her my retroactive pay for those two years and they explained to me that she would send it to me. However, she said I owe her money - I complained again and then off I am to Superior Court - she is appealing the final decision of the tribunal. Is this harrassment and/or discrimination? She should not be able to get away with this.

My supervior came to the department after I did. She has a GED, but has been with the company close to 30 years. I have a college degree, I am the only minority in the department. I have seen several people terminated and resigned because of her. She can make no decision on her own, she has to always go to her boss, if you make a suggestion or recommendation. She talked down to me. She has hired some of friends, given them cushy jobs or cushy assignments, goes on smoke breaks with them and shares information. They double as gatekeepers for her. She has given me a lot of job responsibility hoping I will quit.
