Hi- I was fired from my job after 5 years for swearing and threatening. I know that sounds bad- but I'm telling you the truth- I DID NOT swear and I DID NOT threaten the other co-worker who I had this so called 'incident' with. I have Attention Deficit and Anxiety Disorder and I'm 35 years old. The other co-worker that I had the 'incident' with was overheard by another co-worker of mine 'conspiring' a plan w/ yet another co-worker to get me fired 2 days before the 'incident'. I was the LAST person called in by my team leader to explain what happened. The other party was called in first. I have repeatedly asked for accomodation as far as having a cubicle that was 'away' from the noise. I was never accomodated, but put in the middle of everything. They fired me over the phone. I have not been able to get unemployment insurance due to the fact that it was deemed misconduct by my company. Do you think I have a case here? The co-worker who overheard the 2 co-workers planning to get me fired told our team leader and she NEVER did anything about it.. plus this co-worker is willing to give a so called statement about what she heard. Plus- after I was fired I talked to HR and they knew NOTHING of the plan by my co-workers ( both of whom were involved in the incident ) nor did she know that I had Attention Deficit? Whats up? Let me know what you guys think and if I have a legal complaint? Thank you SO MUCH !!! I'm a bit lost and frustrated at the moment. !! Catherine
