    Am I in the wrong?

    Well here is the story.

    I hired a lady to babysit my daughter. The agreement was that I would pay her $150/week. Well she watched my daughter for a total of five days. Three days the first week and two days the second week. On the last Wed I went to drop my child off and there was no answer and no communication. Until it came to pay...she has been harrasing me saying that I owe her another $150...I paid her $150 the first week...but I feel I don't owe her anymore because she stood me up and ultimately only watched Emily for five days the equivalent of one work week.

    So she followed me to my apartment put her foot in the door and demanded her money. So I quickly wrote her a check (I was very intimidated.)...right away I went online and put a stop payment on the check or what i thought was the check number I gave her...it wasn't and the check ended up bouncing.

    So now she called me and told me to drop the money off at her house tomorrow or she would take legal action. I guess I want to know...can she take legal action? As far as I am concerned I don't owe her the money and I am feeling very harrassed. I could understand if she worked 10 days and I didn't pay her for them but I paid her for exactly what she worked...

    I don't really know what to do and though maybe you guys could help me.

    Reply: First of all, I would contact the police. Obtaining money by threat of or actual violence is illegal. Putting her foot in the door might qualify as trespassing, check your local laws. Why did you feel intimidated?

    Reply: A week consists of 5 days. The first week you over paid her for 3 days. The second week she only watched her for 2 days. 2&3=5days you paid her $150.00. Tell her you will get your own lawyer and yes go the the police and file a report. Tell them about the check and that you felt threatened. You owe her nothing. Let her take legal action it will cost her more in the long run and I think she is just trying to scare you. Did you sign a contract with this woman about how she would be paid? Next time you get a sitter tell her you will pay her per DAY a set amount to be paid at the end of your work week. Some people don't understand that a week of works means 5-7days not when they feel like to. Good luck

    Reply: I am really bad with confrontation...it always makes me nervous...even more so now with all the people around who blow off the handle for little things and kill people...I just want to keep myself and my family safe...Thank you for the advice. I will contact the police...I don't want to press charges but I don't want her thinking she can harrase or intimidate me anymore. Julie

    Reply: Most child care businesses make you buy days, regardless of whether or not the child is there. They can only watch a certain number of children so by enrolling your child you are agreeing to pay them an amount to hold a spot open for you. Based on that I would say your babysitters expectations are in-line with the child care industry. That said, she sounds like a psycho. You two probably should have worked a little more on the details of your agreement prior to starting the child care. Most states require child care providers to be licensed. She doesn't sound licensed so you could always turn her in for running an illegal day care center.

    Reply: I Know it's been some time since this post was posted, however I would like to make a comment regarding it. The first thing I would like to address is, yes I agree with you somehwhat "Chance", usually you have to pay for set days, however the circumstance in this situation is different. It wasn't "barkerfamily" who didn't bring her child to the daycare, it was the "lady" babysitter who STOOD "barkerfamily." up. Which probably ment that she had to rush around to try to find childcare for her daughter. Second-Barkerfamily, when ever you have someone care for your children, you should do a full background check on them, regardless of how much time it may take. If you had done a full background, you might have found out that she has stood up other families or was known to have violent behaviour. You might have also found out that she is very immature. I have no idea why that women felt she deserved another $150/week. Did you make it clear to her how much it would actually be per day ($30.00). Plus was there any discussion as to what would happen if your child did not attend due to illness etc., would you still be charged for the full week? (which was not the case here), and what would happen if she was unable to babysit. Also, why did she stand you up? Was there a miscommunication on when she was suppose to babysit? If, not, I would find out why she didn't want to babysit. One last question I would have for you after your "lady" babysitter behaved this way is: how did she treat your child? If she was violent towards money, how would she treat a child who cranky and whinny? Scary thought, isn't it?
