Minimum wage rates are based on gross (pre-tax) pay, so if your gross pay is at or higher than minimum wage, then your boss is paying you a legal rate. And unfortunately, there are no laws that require an employer to provide employees with sick days, paid or unpaid. The only sick leave that's mandated by law is unpaid FMLA leave, and that applies only to employers with more than 50 employees within a 75-mile radius of each other. The only place where I can see that you might have a claim against your employer is in the area of breaks - some states require that employers give their employees a 30-minute unpaid meal break at one point during their shifts. If your boss isn't giving you an unpaid meal break of at least 30 minutes in duration every day, find out if he's legally required to do this. To find this out, google your state's name and the words department of labor, and then check the regs at that site. |

Unfortunately, employers aren't legally required to provide insurance benefits to their employees either. |
