boss keeping waitresses tips? can she do this??

when i began working for this restaurant, 25% of all the waitresses tips would gp to the cook. After a while we all realized our boss was stealing tips from the cooks tip cup.to avoid this we stsrted giving the tips right to our cook.my boss stopped this direct payment about 3 months ago. today the cook asked me if i still gave my 25%, in replying yes he laughed and said he hasnt received anyones 25% in 3 months, proving my boss is takin it all. Does anyone have any info about this or know if this is even legal??
