Change in hours..not what I bargained for.....

I have been at my job for a while, I was hired to work between 8am and 6pm but they are now expanding the hours until 9PM..I have things going on right now in my personal life that prevent me from working till 9pm...and when I accepted the job at the pay that was offered, it was based on 8am to 6pm. They are not telling us who will be required to work till 9pm, just saying things like we would like volunteers and "we would like to retain the current team" What should I do if I am told I must work hours that am unable to work, and was not hired to work? They are also talking about split shifts, and I live too far away to come in for a few hours, go home a few hours, and come back. This is a GREAT company to work for but I absolutely cannot work this new schedule. The hours would be 12:30 -9 or 11:30-8, etc. for the late shifts.

Bad enough you have to work 8-6, now they are changing your contract alfresco? If you have a written contract of employment, with your original working hours stated on it (or, in your case, however many hours a week it adds up to -- are you 5 days a week on those sort of hours???), AND if there's no clause stating that the conditions of your employment are subject to change without notice, they can't suddenly switch your schedule -- unless your contract is *so many hours a week*, but the actual times are not specified. <<<<<<<<>>>>>>>>>
If you can't work 12:30 - 9, or split shifts, then you can't. End of story. Perhaps there are potential employers closer to your neighborhood?

I told them when I was hired that I am available to work between 8am and 6pm, I ususally work 845-515, very rarely I might something like 830 to 5 or something, but I was verbally told "absolutely no nights" when I was hired. I have been looking around just in case. Verbal agreements are binding in my state according to my former business law professor who was also an attorney, but it would be my word against theirs. I work 40 hours per week 5 days per week...and if they fire me would I be able to collect unemployment? |
