    employer who charges fuel tax

    My daughter and I live in the worst state with the worst unemployment rate right now. Jobs are few. We thought we would go work for cash money driving the Ice cream truck.Summer Song Ice Cream. We did this only a few days. Because she is a con artist. she tells you you will be making 25% commission. Problem is she them deducts from your 25% half of the fuel(gas) it cost her for you to drive all day, then another $10.00 for insurance DAILY ($300.00 a month, I doubt if she pays that out for everyone) then she charges another fuel tax, thats right fuel tax. I have always believed that it was included in the fuel price. Infact I know it is included. So how can she get away with this???? Is Gas not high enough?? Just another way for her to pocket the rest of your earned money so she can have YOU work for her for FREE. So BEWARE TO ALL people hard up for JOBS. THIS IS NO money maker for YOU, only she gets the bucks. my highest day was $40.00 my lowest was $17.00 for 8 hours worked. NOT even min. wage.

    Reply: If you're working for "cash money" then you're not an employee as defined by law, and are therefore not covered by employment legislation (including pay deduction regulations and minimum wage laws). I'm sure this isn't the answer you wanted to hear, however (unfortunately), it's the truth. Your only recourse would be to take this woman to small claims court, however, you need to know a few things before you do this. First, you'll have to get an idea of how much the insurance REALLY costs, so that you can sue for the difference between what she's paying and what she's deducting. Second, she may well fire you the minute she's served with the small claims court papers - and it would be legal for her to do so (again unfortunately).
