    Got lay off after 1.5 month back to work from Maternity leave and parental leave

    To May 23, 2005, I have worked with my company for four years. Last May I took Maternity leave and I returned to work on March 1st , 2005. Yesterday I got notice that my job will be end at April 29,2005. They said they gave me 3 weeks notice according Employent Standard. However, some people told me they should give me 4 weeks notice. Can anyone help me out which is correct and is it legal my company laid off just after I came back from maternity leave? thanks. BTW, I am not even eligible to apply EI because of it.

    Reply: Hi, It depends on which province or state you are in. Each has there own idea of how much notice you need. As for the EI you can apply for social assistance until you find another job. this will be easy becasue you have a child, unless you partner makes to much net income.

    Reply: I am on Ontario. I just called Ministry of Labor office, they told me I am supposed to receive 4 weeks, however when I went back my boss, they showed me the Employment legislation chart that indicate I am only eligible 3 weeks because I worked at this company for 3.9 years, which less than 4years. I believe this is the trick they made. Anyway, thank you very much.

    Reply: If you live in the states, chances are it's a "right to work" state. That being said, any employer is not required to give any notice at all.
