Unpaid Breaks - Help!
Posted by: InTraining

I work at a convenience store in BC, Canada. My boss tells me that during my unpaid lunch break (30 mins), I'm not allowed to leave the premises. I don't think that's right. Could somebody clarify this for me? I'd really appreciate it.

Your problem is simple. The laws very clearly state that unpaid break time is yours to do with whatever you want.
Now, there may be one small gray area. If your employer has a policy that you cannot do anything to defame the company, then you MUST obey that policy. Most companies do have something like this. Otherwise, you are not being paid for your lunch break and therefore it is YOUR time. Legally, your boss CANNOT keep you on the premises. |

Here in Connecticut, you have to be paid for ALL time that you are required to be on the employer's premises. I am not sure what the law is in your area. But this is not fair. |
